To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).

Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise. Without limiting the generality of the foregoing exclusion, we will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms and conditions or in connection with our website, whether direct or indirect, and whether arising in tort, contract, or otherwise.

However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.

Access to certain areas of our website is restricted. We reserve the right to restrict access to [other] areas of our website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.

We may disable your user ID and password at our sole discretion if you breach any of the policies or terms governing your use of our website or any other contractual obligation you owe to us.

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.

You must not use our website in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. 

You must not use our website for any purposes related to marketing without our express written consent.

You must not use our website to copy, publish or send mass mailings or spam.

You must not use our website to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under English and other applicable law. All material you copy, publish or send via our website must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person’s intellectual property rights or rights of confidence, impinge upon any person’s privacy, or constitute incitement to commit a crime[; further, material must not be misleading, deceptive, sexually explicit, threatening, abusive, harassing or menacing.

We reserve the right to edit or remove any material posted upon our website.

We may take such action as we deem appropriate to deal with the posting of unsuitable material, including suspending or cancelling your account, restricting your access to our website, or commencing legal proceedings against you.

In respect of all material that you post on our website, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute such material in any media, together with the right to sub-licence such rights.

(6)(1)   By providing us with your e-mail address, at any point whether on application for a Deed Poll or before, you authorise us to sign you up for the UK Deed Poll Forum.

You agree that you are aged 13 or older. You ackowledge that while the administrators and moderators of this forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. Therefore you acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster (except for posts by these people) and hence will not be held liable.

You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions. You agree that the webmaster, administrator and moderators of this forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.

This forum uses cookies to store information on your local computer. These cookies do not contain any of the information you have entered above; they serve only to improve your viewing pleasure. The e-mail address is used only for confirming your registration details and password (and for sending new passwords should you forget your current one).

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

(9)        Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.

Terms and Conditions for the Sale of Goods

 

You will be asked to expressly agree to these terms and conditions before ordering Products from this Site. Please read them carefully. If you do not agree to them, do not order any Products from this site. In order to indicate your acceptance of these terms and conditions, you must click on the button marked “I Agree” at the end application form.

Please note that you may only purchase Products from this site if you are over 16 and resident in England or Wales.

(1)        Definitions and interpretation

In this Agreement “we”  means The Legal Deed Service Limited (and “us” and “our” shall be construed accordingly); and “you” means the relevant customer or potential customer as the case may be (and “your” shall be construed accordingly).

In this Agreement, the following definitions shall apply:

“Agreement” means this agreement incorporating any terms set out in our Second Acknowledgement;

“First Acknowledgement” means the initial automatic email acknowledgment which we will send to you after receiving your Order;

“Order” means your order for Products made via the Site;

“Products” means goods which may be purchased by you from the Site;

“Second Acknowledgement” means the email acknowledgment which we will send to you (where appropriate) confirming acceptance of your Order; and

“Site” means the website at http://www.thelegaldeedservice.org.uk/ or http://www.thelegaldeedpollservice.org.uk/  or any successor site operated by us from time to time.

(2)        This Agreement

The advertising of Products on the Site constitutes an “invitation to treat”; and your Order for Products constitutes a contractual offer. No contract comes into force between you and us unless and until we accept your Order.

In order to enter into this Agreement with us, you will need to take the following steps: (i) you must read the guidance provided on every page published on our site; (ii) you must choose the most appropriate Deed Poll to suit your specific requirements; (iii) you must ensure that you have read statutory information relating to your change of name; (iv) you must complete the online application and submit it; (v) n accordance with The Electronic Commerce (EC Directive) Regulations 2002 we will then send you the First Acknowledgment; and (vi) once we have checked whether we are able to meet your Order, we will either send you the Second Acknowledgement (at which point this Agreement will become a binding contract) or we will confirm by email that we are unable to meet your Order.”

Please note that we will not file a copy of this Agreement. We may update the version of this Agreement on the Site from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of this Agreement for your records.

The only language in which we offer this Agreement is English.

(4)        The Products

Adult Deed Poll

The Adult Deed Poll is for use by British Citizens, Foreign Nationals, Asylum Seekers and Refugees (a) who are currently living in the United Kingdom, and (b) who have attained the age of 16 years.

Adult (Gender Title) Deed Poll

The Adult (Gender Title) Deed Poll is for use by British Citizens, Foreign Nationals, Asylum Seekers and Refugees, (a) who are currently living in the United Kingdom, and (b) who have attained the age of 16 years.

Child Deed Poll

The Child Deed Poll is for use by British Citizens, Foreign Nationals, Asylum Seekers and Refugees, (a) who are currently living in the United Kingdom, and (b) who have are aged 15 years or young. The Child Deed Poll can only be ordered by the person, or one of the persons, who have parental responsibility for the child. You are only permitted to use the Child Deed Poll to change the name of a child if you have obtained the consent of all those persons who may have parental responsibility for child.

You are entitled to a 5.00GBP discount if you are applying for a Deed Poll and you intend to use that Deed Poll to change the name of a child, under 15yrs of age, for whom you have parental responsibility.

Free Certified Copy

If you return the executed Deed Poll to us we will copy it and provide you with a Certified Copy. You can only return your Deed Poll to us by scanning the image in to your computer and returning it by e-mail. At our discretion, we may permit you to post the Deed Poll to us.

Free Archive Service

If you return the executed Deed Poll to us we will take a digital copy thereof and we will store it in a Digital Archive. We will charge you 5.00GBP if you wish to obtain a copy of the image that we hold in storage.

We will store this Deed Poll indefinitely; however, we reserve the right to withdraw this service at any point in time. If we decide to withdraw this service we will serve you with notice by e-mail 10 days in advance of the service expiration date.

Certified Copies

The purchase of certified copies means that we will send you copies of the original deed. Such copies may not be certified and may need to be signed in the normal way. Certified Copies can take upto 14days for delivery post order.

Free Verification Service

We will verify the authenticity of the Deed Poll that we have issued you with to any organization that contacts us. You hereby give us permission to do this.

(5)        Guarantee

Deed Polls supplied by The Legal Deed Service are accepted by UK organizations and UK government departments as legal documentary evidence of your change of name.

If a UK organization refuses to accept your Deed Poll we will speak to them on your behalf. If after we have spoken to the organization concerned the Deed Poll is still not accepted, we guarantee to refund in full any payment that has been made to The Legal Deed Service in respect of that Deed Poll. If we are unable to communicate with the organization, we will not refund any money until we have received written confirmation, from the organization that refuses to accept the Deed Poll, on letter headed paper or by an e-mail bearing any such organizations electronic address. This is the limit of our liability.

Refunds are normally made back to the same credit or debit card that was used to make the purchase. In the case of cheque transactions, refunds will be made by cheque, payable to the person whose bank account the original cheque was drawn on.

Our guarantee does not apply in the following circumstances:

  • Your Deed Poll is for a person aged 15 or under and it is not accepted because you do not have the consent of all adults with parental responsibility. Consent requirements are covered within the Deed Poll application process and are displayed on the Application for Children page published on our Site. The Legal Deed Service accepts no responsibility whatsoever for any action legal or otherwise that may result from failure to obtain the rightful consent for a child's name to be changed.
  • Your Deed Poll is not accepted because you have not correctly signed and dated your Deed Poll, or you have not had it correctly witnessed. We provide you with full instructions on how to correctly execute your Deed Poll document.
  • You are a foreign national living outside of the UK
  • Your Deed Poll is declined by a foreign organization. (Our guarantee applies to UK organizations based in the UK only)

5.1.Any guarantee provided on our site to the effect that if you find a cheaper online comparable service we will match it or refund your money, does not apply and will not come into force, unless you find another online provider of Deed Polls that (a) is or was trading as a Limited Company three-months prior to the date of your purchase or three-months prior to your consideration to purchase our Products and or Services, and (b) any such guarantee does not apply and will not come into force unless any such service, in addition to it being incorporated at companies house for three-months or more,  provides the exact services that we provide for a price less than the price stated on our website for each individual Product (Deed Poll).

5.2 For the purposes of clarification, unless the company that you find is using a company that has been incorporated at Companies House for three months or more, moreover, unless that company provides (i) a free lifetime verification service, (ii) a free legal certified copy, (iii) free letter-templates & a free archive service (iiii) a free e-copy within 3hrs, you will not be entitled to benefit from guarantee mentioned in 5.1 above.

 

(6)        Price and payment and additional fees.

The prices stated on our website are correct.

In addition to the price of the Products, you will have to pay a non-refundable administration, postage & packaging fee, currently 17.5% of the total price stated.

We do not claim Value Added Tax.

Payment for all Products must be made by Credit or Debit Card, chaps, bacs or by cash at the bank. If you are paying by cash at the bank, or by bacs, we will not dispatch your Deed Poll until the payment has reached us and has cleared in our account.

Prices for Products are liable to change at any time, but changes will not affect Agreements which have come into force.

When you submit an order you must pay for it within one hour of submitting the application form.

Unless paying at the bank or by bacs, if you fail to make payment within 1 hour of submitting the application, , you will be liable for a £4.50 late payment fee, plus 17.5%. You agree that we will not release your Deed Poll, until this fee has been paid.

If you make a mistake we will charge you an administration fee of 5.00GBP (+17.5%) before we will correct your mistake. If we make a mistake we will rectify it free of any charge. We will not make any amendments to your application form. Once you have submitted the application, we will carry out our obligations by drafting your Deed Poll in the way in which you have stipulated in your application form.

If, having failed to read the information published on our website, you complete the wrong application form, we will not make any ammendments until the outstanding amount for the correct application has been paid. You will also be charged a 5.00GBP (+17.5%) to cover the cost of ammending the error.

You agree that we will not release your original Deed Poll until all outsdtanding fees have been paid.

(7)        Delivery

We will arrange for the Products to be delivered to the address for delivery indicated in your Order.

We will use reasonable endeavours to deliver Products on or before the date for delivery set out in our Second Acknowledgement or, if no date is set out in our Second Acknowledgement, within 14 days of the date of our Second Acknowledgement. However, we cannot guarantee delivery by the relevant date. We do however guarantee that unless there are exceptional circumstances all deliveries of Products will be dispatched within 96 hours of the later of receipt of payment and the date of our Second Acknowledgement.

(8)        Consumer rights

In accordance with s. 13(1)(a) The Consumer Protection (Distance Selling) Regulations 2000 Statutory Instrument 2000 No. 2334, because we will complete and dispatch your order before the expiration of the seven day right to cancel period, your right to cancel the order is restricted to the period of time which lapses between submitting your order and your order being processed by us. The initital part of your order will be processed within one hours of the application being received by us.

When you submit an order for your Deed poll you agree to waive your right to cancel within the seven day period.

We endevour to release you order by e-mail within three hours of submission, however, due to demand this is not always possible. Furthermore, you agree that we will not be held responsible if your e-copy is delayed resulting from a technical error with our systems. In all circumstances, we will endevour to deliver your e-copy within five days from the time that payment was received.

You agree and understand that you order can be delayed by a maximum of 5 business days, in the event that your application was inaccurate, incomplete or in circumstances where the payment is delayed.

Notification of cancellation should be sent to: reception.desk@thelegaldeedservice.org.uk within one hour of payment.

(9)        Refunds

If you cancel this Agreement and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event; within 30 days of the day we received your notice of cancellation.

The offer of a full refund if your Deed Poll is not delivered within 4hrs, does not come into force, unless you submitted your order between the hours 9am and 5pm. If you submitted your order after the aforesaid, you are not entitled to a refund. If you submit your order between 5pm and 9am, we will endevour to deliver your Deed Poll by e-mail, before 12noon on the next business day. We cannot guarantee that we will deliver it before 12noon on the next business day. The offer of a refund simply means that your money will be refunded. The Deed Poll will not be provided FREE OF CHARGE. You are not entitled to a refund if you request the refund after you have received the eCopy.

(10)      Warranties

We warrant to you that any Product you purchase through the Site will be of satisfactory quality.

You warrant to us that: you have full authority, power and capacity to enter into this Agreement and that all necessary actions have been taken to enable you to lawfully enter into this Agreement; you are legally capable of entering into binding contracts; you are at least 16 years old; the information provided in the Order is accurate; and you will be able to accept delivery of the Products as contemplated in this Agreement.

Subject to the warranties set out in above, to the maximum extent permitted by applicable law we disclaim all warranties with respect to the Products, whether express or implied. 

(11)      Limitations of liability

Nothing in this Agreement shall limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) under section 12 of the Sale of Goods Act 1979, section 2 of the Supply of Goods and Services Act 1982, or section 2(3) of the Consumer Protection Act 1987; (iii) for fraud or fraudulent misrepresentation; or (iv) for any matter for which it would be illegal for to limit or exclude, or attempt to limit or exclude, liability.

Subject to this: (i) our liability in connection with any Product purchased through our site is strictly limited to the higher of the purchase price of the relevant Product and the replacement cost of the relevant Product; (ii) we accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable; and (iii) we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement caused by events outside our reasonable control.

(12)      General terms

Images of Products on the Site are for illustrative purposes; actual Products may differ from such images.

We will treat all your personal information that we collect in connection with your Order in accordance with the terms of our Privacy Policy; use of our website will be subject to our Website Terms and Conditions.

This Agreement may only be varied by an instrument in writing signed by both you and us. We may revise these terms from time-to-time, but such revisions will not affect the terms of any Agreement which we have entered into with you.

If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.

No waiver of any term, provision, or condition of this Agreement, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that term, provision or condition or any other term, provision or condition of this Agreement.

You may not assign, charge, sub-contract or otherwise transfer this Agreement, or any of your rights or obligations arising under this Agreement.   Any attempt by you to do so shall be null and void. We may assign, charge, sub-contract or otherwise transfer this Agreement, or any of our rights or obligations arising under this Agreement, at any time – providing such action does not serve to reduce the guarantees benefiting you under this Agreement.

This Agreement is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under this Agreement is not subject to the consent of any person who is not a party to this Agreement.

This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written. 

This Agreement will be governed by and interpreted in accordance with the laws of the England, and the English courts shall have exclusive jurisdiction with respect to any dispute arising under this Agreement.
